Anti-SLAPP Motion Against Urban Logic's Beaumont Lawsuit Reported in The Press-Enterprise

January 13, 2011

UPDATE from Reid & Hellyer (2/15/11): The Anti-SLAPP Motion was granted.

workingmasthead.jpgAs reported in The Press-Enterrise and the Inland Empire's Business Press, lawyers from Riverside law firm Reid & Hellyer filed an Anti-SLAPP motion on behalf of Beaumont Citizens for Responsible Growth (BCRG) against Deepak Moorjani, Ernest Egger and David Dillon, and their company, Urban Logic Consultants, Inc. (Urban Logic) in Riverside Superior Court on Monday, January 10.

The Anti-SLAPP motion calls for dismissal of a lawsuit that was filed against Beaumont Citizens for Responsible Growth (BCRG) for reporting on their website that since 1993 the City of Beaumont paid over $23,000,000 to Moorjani, Egger, and Dillon’s company while the three were serving Beaumont as its Public Works, Planning, and Economic Planning Directors.  The lawsuit also targeted BCRG’s reports that Beaumont’s public contracts have been steered to a few favored companies, denying others a fair opportunity to bid.

The motion is based on BCRG’s position that Urban Logic’s lawsuit is an unconstitutional infringement on local citizens’ First Amendment rights to comment on matters of public concern, and that the information on their website is based on public records.  The motion was filed accompanied by ten sworn Inland Empire Business Press, Riverside and San Bernardino Countiesaffidavits and some of the hundreds of documents that Beaumont City officials had disclosed in response to BCRG public records requests over the past five years.

The motion is currently scheduled for hearing on February 15. The case is Riverside County Superior Court Case No. RIC 10019763.
